Terms of Use

Installing or using the "Where's My Child?" app means you accept these terms. If you do not accept them, do not install or use the app.

Use is at your own risk

You use the app, and everything it shows you, at your sole risk. You are fully responsible for any decision, action or inaction you take based on the app, including in an emergency.

By using the app you confirm that you have read, understood and accept the following limitations:

• The app is an aid only. It does not replace parental supervision or emergency services.
• Location, alerts and messages may be delayed, inaccurate, or may not arrive at all.
• A phone that is switched off, in airplane mode, out of battery, without a network, or on which the app has been force-quit reports nothing — and you may not learn of that immediately.
• The operating system, Apple, Google, cloud providers and networks may limit or stop the app without notice and beyond our control.
• The absence of an alert is not confirmation that everything is fine.

Do not rely on the app as the only safety measure for a child.

Purpose of the app

The app is intended for sharing location, status and safety tools within a family, openly and visibly to the child. It must not be used to track any person without their knowledge and consent.

The parent's account and responsibility

A parent account is created and managed by an adult. The parent is responsible for connecting children and additional parents, for the privacy, location, alert and screen time settings, and for use in accordance with the law that applies to them.

Fair use

The app must not be used to violate privacy, to attempt access to another family, to pass an invitation code to an unauthorised person, or for any unlawful purpose. A breach may result in the account being restricted.

Age and legal capacity

A parent account is intended for adults aged 18 or over. By opening an account and connecting a child, you declare that you are that child's parent or legal guardian, or that you have the guardian's consent, and that you are legally permitted to configure location sharing and screen time management for them. Verifying that authority is your responsibility alone.

Safety and emergencies

The app is an aid only and does not replace parental supervision, judgement or emergency services. It must not be relied on as a sole safety measure. In an emergency, contact the official emergency services immediately.

Location, alerts and messages depend on the device, its battery, the mobile network, location services, the permissions granted and third-party services. They may be delayed, inaccurate, sent late, or not sent at all. A phone that is off, in airplane mode, out of battery, or on which the app has been closed will not report at all.

Availability and third-party dependencies

The app is provided "AS IS" and "as available", without any warranty, express or implied, including as to fitness for a particular purpose, accuracy, or uninterrupted availability.

The service relies on external providers, including Apple, Google, cloud services and communication networks. We are not responsible for faults, changes, interruptions or limitations originating with them or with the operating system, including changes to location permissions, notifications or Screen Time capabilities.

Limitation of liability

To the extent permitted by law, we will not be liable for indirect, consequential or special damage, or for loss of profit, data, time or reputation, arising from use of or reliance on the app, including where information was wrong, missing, late or never received.

In any event, our total liability on any cause of action will not exceed the amount you actually paid for the service in the three months preceding the event; where no payment was made, no monetary liability applies.

Nothing here excludes liability that cannot be limited by law, including for wilful misconduct.

Indemnity

You undertake to indemnify us for any claim, demand or expense, including legal fees, arising from your use of the app in breach of these terms or of the law, including tracking a person without authority or without their knowledge.

Subscription and payments

The app includes basic capabilities free of charge and an optional monthly premium subscription. The governing price and currency are shown in the store according to the user's country and store account, before payment is confirmed. The subscription renews automatically each month until cancelled through the Apple or Google account. Purchases can be restored and the subscription managed from within the app. Deleting the app account does not cancel a store subscription, which must be cancelled separately. Refunds are subject to store policy.

Screen Time capabilities built into the operating system are part of the free service and are not sold as a premium capability.

Intellectual property

The design, marks and code of the app belong to the app's developer. They may not be copied, modified or distributed without permission.

Account deletion and changes

An account can be deleted from within the app. We may change, limit or discontinue the service or parts of it, and may suspend an account that breaches these terms. We may update these terms; continued use after an update constitutes acceptance of the updated terms.

Governing law and jurisdiction

These terms are governed solely by the laws of the State of Israel. Exclusive jurisdiction over any dispute lies with the competent courts of the Tel Aviv district.

Severability

If any provision of these terms is found unenforceable, the remaining provisions remain in force, and that provision will be interpreted as narrowly as necessary to make it valid.
